This is a research memo explaining that a Family Offense Petition (“FOP”) filed by a respondent and one filed by Administration for Children’s Services (“ACS”) can proceed simultaneously. Article 8 of the New York Family Court Act does not bar concurrent FOPs for a mother and/or her children. Recognizing the seriousness of domestic violence, the Legislature ensures victims have effective access to courts.
